EGLE (Environment, Great Lakes, and Energy) is the Michigan state agency responsible for environmental regulation and protection. It oversees programs related to air, water, land, and remediation. Most environmental permitting and compliance in Michigan is managed through EGLE.
Part 201 is shorthand for the Natural Resources and Environmental Protection Act (Act 451 of 1994, Part 201 – Environmental Remediation) This is one of Michigan’s environmental laws governing contaminated sites and remediation. It establishes criteria for cleanup and liability for environmental contamination from sources other than underground storage tanks. This law outlines response activities for releases, and guides consultants and the public from release to closure. Part 201 also includes the necessary duties and responsibilities of owners and operators of sites with contamination.
Part 213 is shorthand for the Natural Resources and Environmental Protection Act (Act 451 of 1994, Part 213 – Environmental Remediation) addresses contamination caused by regulated leaking underground storage tanks (USTs). It outlines requirements for owner responsibilities, investigations, cleanup, and reporting. This regulation helps to guide consultants and the public from the time of release to the closure of the site while ensuring that releases are handled properly in the interest of public health.
A No Further Action (NFA) report details the completion of remedial actions and postclosure plans or agreements where applicable. Approval indicates that no additional remediation is required under current conditions.
An IAR is the first step in reporting a release for a Part 213 applicable site. This report is required to be submitted to EGLE within 180 days from the date the release is discovered. The report contains details like the location of the release, the type of release, the on-site extent of the release, and site classifications.
A FAR is submitted by the liable party in a Part 213 release. This report includes a corrective action plan developed under section 21309a of Act 451. This report is required to be submitted within 365 days from the date the release was discovered. Once the report is submitted, EGLE will make a decision on the closure of the site.
A Remedial Action Plan describes the remedial response proposed to address the impact(s) from a release. The report will detail how contamination at a site will be addressed, including methods, timelines, and cleanup criteria. This plan guides consultants, owners and operators through cleanup activities and regulatory compliance.
A Conceptual Site Model outlines the exposure assessment and a basis for a risk assessment. It’s a big picture model that describes the contamination source(s), the fate, and transport of the material, and identifies exposure pathways, receptors and resources that may be affected. This model is iterative and helps guide investigation and remediation strategies.
